Yes you can go to school part time on H1 for MBA. Some states allow you to claim in state tuition on H1 for state schools - that will significantly reduce the tuition bill. In addition Federal govt allows either a deduction of $4k / yr or a credit of up to $2 k / yr (search for tuition tax deduction and Lifetime Learning credits).

RFE's during I 485 - consolidated
I though it would be a good idea to start consolidating all the RFE's, so that people would have one thread to look at if at all there is any RFE
Note: If there is already a thread, admins please delete this thread
1. RFE on current employment and offer of proposed employment (description of position) and offered salary
2. Current address proof
3. Missing G325-A need to submit one (but I did send them initially)
4. Evidence that you maintained non immigrant status from the date of first entry till the date you filed your I 485

Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs
I am not totally sure. I recall reading one amendment where they mentioned 203(b) in conjunction with this - which means EB2 qualification.

I believe when DOS calculated the Eb2 China demand data for July, they might have taken all apps pending from Nov22 2005 till Dec 31 2005. Considering the apps prior to Nov 22 2005 as demand for June 2010.
Same for Eb2 India from Feb1 2005 till Dec 31 2005. To make note is India dates did not change in June so the demand remains the same for that year.

All this inventory etc dosent make sense ,
Pending EB2 cases for china are around 2000 as per USCIS inventory .
but as per DOS Demand data its only 500 ..
God Knows whats Happening .

Does any one in the forum (or their spouse) work for the state of california?
Are H1B or EAD holder eligible for applying for full time postitions with the state?
How about after getting the green cards? Are permanent residents eligible? OR are these positions only for US citizens?
I recently took the state exam for Systems software specialist series and when filling up the online forms etc, there was no question asked anywhere about citizenship or permanent resident only.
So if any of you have experience in this area, could you please clarify?

Could you all please give me an opinion on this situation? I am trying to ask my lawyer, but I won't know for a few days and this is disturbing me a lot!
I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?

Are there people who are current now, who have no Priority Date mentioned on the I-485, EAD and AP receipts? (i.e. the PD box is blank)
The priority date is shown on my I-140 receipt, but not on the aforementioned documents.

I would like know if any of the IV members whose I-140 applications were transfered to VSC for receipting has been approved. If those IV members have received any kind of communication from VSC regarding processing of I-140 please post the details for benefit of other members. My case should have been processed at TSC, but was sent to VSC for receipting and has been stuck there for quite some time. It appears that VSC has stopped processing I-140's as of April 2006 and have not processed any applications since then. I would sincerely appreciate if members with I-140 at VSC to please post any updates they may have received. Any idea when I-140 PP will be reinstated?

Gentlemen,
I had a quick question with EAD I understand that I can switch job after 180 days as long as there is 50% match in job description. However my companiy's legal coordiantor send me a weird query that she cannot find the job in hard to fill category. So my question is Does the job I am applying for using my EAD has to be hard to fill as in case of H1 or the only requirement is that the job description should match 50% with the underlying LC.

No problem, because of the work NSC are transferring some cases to Texas. In fact, Texas center is issuing EAD and AP so fast. so your wife will get her EAD very soon.

I moved to a different place (same city), but my wife is out of country. I am trying to file AR-11 for change of address, but it is asking for Last Port of entry. Is AR11 needed only for people who are currently in the country.
She needs to fill-in new address in the I-94 form at the time of reentry into the US. She won't need to file AR-11, as her I-94 has most recent address.
Please verify this with your attorney.
