Hi Gurus,
Thanks for your time on this post. I appreciate your responses.
I have a question regarding AP. I have AP's based on my pending 485. Recently i traveled to India (on a family emergency) using my AP which was issued in 20th Nov 2008 valid till 19th Nov 2009. I had no issues & got thru JFK using the same.
I was out of US from Sep 23rd thru Oct 24th 2009.
Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.
My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.
Do you guys foresee any other issues? , I herd that the AP is NOT valid if you are out of the country.

AFAIK, your new AP is valid and usable; get a second opinion from an attorney. Re-post in attorney's section.

Hello friends - the recd. date on my 765 application is August 7th...it's almost 90 days now (11/5 - next monday) that my application will be pending.!
Same is the case with AP..! No news at all for EAD & AP..Worried now!
Can i make a appt. with INFOPASS for both my EAD & AP together...? And what is the A # that they ask for when we fill Infopass appt.? Is it A # on 48 receipt notice.? OR A # on 140 approval notice.!

Can someone work in US on H1B and in India for an Inidan company and get paid in Inidan currency? If H1B restricts you from doing so I am willing to switch to EAD if that permits me from working remotely for indian company.

Hey gaurav - I double checked with a few colleagues, and this is a WPF issue. Unfortunately, there isn't a good workaround at this time. My only suggestion would be to not use those abnormally wide fonts at large text sizes :P

Hi,
I'm on L1B and wife on L2B with EAD and currently working. Both are expiring on Dec 30,2010. I got my H1 with COS, which is effective from Oct 01,2010 for 1 year and my wife got H4, effective from same time. My wife's company is filing for H1 for her and has already applied for LCA. After the LCA, they are not sure whether to apply for COS from L2 to H1 before Oct 1st or if they want to wait till Oct 1st and then file for new H1 with COS from H4 to H1. In the second case, she will not be able to work till she gets her H1.
Also if they file for H1 before Oct 1st with L2 to H1 COS, and if she gets RFE, then not sure whether the whole application is invalid as my wife's status would have changed from L2 to H4 during the course.
Please advice my options. Is it OK if her company file for new H1 with COS from L2 to H1 as soon as her LCA get approved with premium processing? Is it going to be a problem if she gets RFE?
Or is it adviseable to continue to be on L1/L2 till she gets H1? If yes, how can I change my status back to L1 before Oct 1st 2010? Can my company do it me? How long the process will take? I also heard that if I go abroad and come back, I will continue to be on L1. In that case should my wife acccompany me? Do I have to go out and re enter before Oct 1st?
If I change my status back to L1, what will happen to my H1? Will it still be valid? If I'm planning to change to a different company, can it be just transferred to that company and I can work there?

It won't be through any company. It would be through the school itself. If the school needs a teacher then it can file for his/her h1b.

1..I would like to know if an employer revokes 140, and if the AC21 is not submitted at the time of NOID...how many days are given by USCIS?
Is it 30 days?
2..If I go to another emplyer and try to do interfile, still I need to file AC21?
And if the new category is EB2(my old application is EB3), still is that ok?
For eg..EB3 title is system analyst, and if I want to go for Eb2 then which could be more apprepriate..?Senior SYSTEM ANALYST

You said that by AUG 2008 bulletin, your dates are current.. Which date we should refer to? Date from I-140 or date from I-485?

I took an infopass appointment last october and my FBI name check status was pending. After seeing the USCIS memo on march4th that all namecheck pending for 180 days has been cleared by feb 28th 2009, i went again for an infopass appt last week. IO toldme that my namecheck is still pending.
So i contacted my senators office same day and sent all my info along with the USCIS memo. Next day senators office called me back and told me that they called USCIS and came to know that my name check has been cleared. Senators office told me that infopass information could be wrong or may not have been updated.
IS that a possibility ? any inputs ?
I took infopass again last week and the IO told me the FBI name check is still pending. My lawyer initiated and inquiry to nebraska serv center and got following notification
"CIS electronic records indicate that both applicants have current Fingerprint results and FBI name checks"
